The Mutual Defence Treaty between the Republic of the Philippines and the United States of America (MDT) was signed on August 30, 1951 in Washington, D.C. between representatives of the Philippines and the United States. The comprehensive agreement contains eight articles and dictates that the two nations would support each other if the Philippines or the United States were attacked by an outside party. The broader context is that President Duterte has tried to create a greater distance between the Philippines and the United States – what he calls an „independent foreign policy.“ Among the various elements of this approach are contact with Russia for closer relations and potential arms sales, as well as efforts to strengthen economic and diplomatic relations with China, even as the Philippines continues to address (with diminishing force) China`s intrusion into its exclusive economic zone in the South China Sea. But scholars have argued that American overseas military bases are the poor of the informal empire, because of the power imbalance between the United States and most of the host countries. In the case of U.S.-Philippine relations, the power imbalance is even more pronounced given the formal colonial history between the two nations. These custody and incarceration clauses are part of this forced relationship, as they directly limit the sovereignty of the Philippines to make decisions on criminal proceedings within their geopolitical limits.
